Terms for online courses and digital educational content offered by Videohudozhnik
Last updated: September 21, 2026

This Public Offer Agreement is a legally binding offer by Individual Entrepreneur Artem Volodymyrovych Havrylenko (the “Provider”, “we”, “us” or “our”) to supply online educational services and grant access to digital content on the terms below. It applies to purchases made through https://intensive-eng.videohudozhnik.online and any checkout or learning platform linked from that website.

By placing an order, checking the acceptance box, paying for a Product, or accessing paid materials, you confirm that you have read and accepted this Agreement. If you do not accept it, do not purchase or access a Product.

1 Definitions

  • “Customer” or “you” means a legally capable individual who purchases or uses a Product.
  • “Product” means the online course, intensive, lesson collection, downloadable file, webinar, or other educational offer described on the relevant sales page.
  • “Content” means videos, audio, text, images, worksheets, presets, filters, LUTs, sound files, links, and other materials included in a Product.
  • “Website” means the website on which this Agreement is displayed, including the domain stated above and any successor domain operated by the Provider.
  • “Account” means the personal area on the learning platform through which Content is delivered.
  • “Platform” means the Website, learning management system, payment page, messaging service, or other third-party technology used to sell or deliver a Product.

2 Acceptance and Contract Formation

1. This Agreement is a public offer under the laws of Ukraine. A contract is formed when you accept this offer by completing the checkout, making payment, or receiving access to paid Content.

2. You must have legal capacity to enter into this Agreement. If local law requires parental or guardian consent, the relevant adult must complete the purchase and accept this Agreement.

3. The sales page, checkout page, order confirmation, and Product description form part of this Agreement. If a Product-specific term conflicts with a general term here, the Product-specific term applies to that Product, subject to mandatory law.

3 Products and Scope of Services

1. The content, format, price, access period, release schedule, and any included support are stated on the relevant sales page or checkout page.

2. Unless expressly stated otherwise, Products are self-paced digital products consisting of prerecorded lessons and downloadable materials. Personal mentoring, individual feedback, live meetings, and guaranteed review of assignments are not included.

3. We may make reasonable updates to improve or maintain Content, provided that the core nature and value of the purchased Product are not materially reduced.

4. You are responsible for having a compatible device, internet connection, current browser or app, and any software identified in the Product description.

4 Orders Prices Payments and Taxes

1. The price and currency shown at checkout are the price and currency applicable to your order. Any bank conversion fees or card issuer charges are outside our control unless the checkout states otherwise.

2. Payment is processed by the payment provider or merchant of record shown at checkout. That provider may collect billing information, perform fraud checks, calculate or collect applicable taxes, and issue payment documents under its own terms.

3. Where a merchant of record is identified at checkout, it acts as the seller of record for payment, invoicing, indirect tax, and refund administration to the extent stated in its terms. The Provider remains responsible for supplying the educational Product.

4. Access may be withheld until full payment is confirmed. If a payment is reversed, charged back, cancelled, or found to be unauthorized, access may be suspended while the matter is investigated.

5. Promotional prices apply only during the period and under the conditions stated in the relevant offer. A later price change does not change an order already paid in full.

5 Delivery and Access

1. Digital delivery occurs when an access link, login details, or Content is sent to the email address or telephone number you provided, or when access becomes available in your Account.

2. Lessons may be released immediately or according to the schedule shown on the Product page. Unless a different period is stated there, access lasts 365 days from the stated start date or activation date.

3. You must provide accurate contact information and check spam, promotions, and similar folders. Contact us promptly if access details do not arrive.

4. Scheduled live elements, if expressly included, take place at the announced time. If you miss one for reasons outside our control, we are not required to repeat it. A recording is supplied only when the Product description says so.

5. Temporary maintenance, internet outages, or third-party platform incidents may interrupt access. We will take reasonable steps to restore access and, where appropriate, extend the access period.

6 Cancellation Refunds and Statutory Rights

1. Except where mandatory law or the Product description provides otherwise, payments are non-refundable after digital access has been granted or delivery of the digital Content has begun.

2. Where applicable consumer law grants a withdrawal or cancellation right, that right remains unaffected. For immediate access to digital Content, you may be asked to give express consent to begin performance during the withdrawal period and to acknowledge that you may lose the right to withdraw once supply begins, to the extent permitted by law.

3. A request must be sent to the contact email and include the purchaser name, purchase email, order details, reason for the request, and any relevant evidence. The payment provider shown at checkout may administer the refund.

4. If we cancel a paid Product and do not provide a reasonable replacement, you are entitled to a refund for the undelivered part. Nothing in this Agreement excludes remedies that cannot lawfully be excluded in your country.

7 Customer Responsibilities and Acceptable Use

1. Keep your login details and individual access links confidential. You are responsible for activity through your Account unless you promptly report unauthorized access.

2. Do not share an Account, bypass access controls, scrape or copy the Platform, upload malware, interfere with other users, or use the Product for unlawful activity.

3. Where a community is provided, communicate respectfully and do not post unlawful, abusive, discriminatory, pornographic, infringing, deceptive, or spam content.

4. We may remove content, restrict community participation, or suspend access where reasonably necessary to protect users, the Platform, intellectual property, or legal compliance. Where practical, we will explain the reason and allow you to contact us.

8 Intellectual Property License

1. All Content is protected by copyright and other intellectual property laws. Ownership is not transferred to you.

2. After full payment, you receive a limited, personal, non-exclusive, non-transferable, revocable license to view and use the Content for your own education during the access period.

3. You may use skills and general ideas learned from the Product in your own creative and commercial work. You may not reproduce, distribute, sell, sublicense, publicly display, translate for distribution, upload, share, or create a competing course from the Content without prior written permission.

4. Downloading is permitted only where a download function is provided. Any permitted copy remains subject to this Agreement.

5. If infringement or unauthorized account sharing is established, we may terminate access and pursue remedies available under applicable law.

9 Educational Nature and Results

1. Products are educational and informational. They are not professional legal, tax, financial, medical, or business advice.

2. Examples, student work, testimonials, and marketing statements illustrate possible experiences and are not guarantees of income, employment, audience growth, creative results, or any other outcome.

3. Your results depend on your effort, experience, equipment, market conditions, and other factors outside our control.

10 Third Party Services

1. The Website and Product may rely on payment processors, learning platforms, hosting, email, analytics, video, messaging, and cloud services. Their separate terms and privacy policies may apply.

2. We are not responsible for independent third-party websites or services, but this does not limit our responsibility for selecting and managing processors where applicable law makes us responsible.

11 Suspension and Termination

1. We may suspend or terminate access for material breach, non-payment, chargeback abuse, security risk, unlawful conduct, intellectual property infringement, or serious disruption of the Platform or community.

2. Where the breach can reasonably be corrected, we may give notice and time to correct it. Immediate action may be taken where necessary to prevent harm or comply with law.

3. Termination does not affect accrued payment obligations, intellectual property protections, confidentiality obligations, or provisions intended to survive termination.

12 Liability

1. Each party is responsible for loss caused by its breach of this Agreement or applicable law.

2. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss; lost profit, opportunity, data, or reputation; or loss caused by your equipment, internet provider, or independent third-party service.

3. To the maximum extent permitted by law, our aggregate liability connected with a Product will not exceed the amount you paid for that Product.

4. Nothing limits liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, or mandatory consumer remedies.

13 Force Majeure

Neither party is liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, civil unrest, government action, widespread communications or power failures, cyber incidents, strikes, or changes in law. The affected party must take reasonable steps to reduce the impact and resume performance. Payment obligations for Content already delivered are not excused.

14 Privacy and Communications

1. Personal data is handled under the Privacy Policy displayed on the Website.

2. Operational messages about orders, access, security, and Product delivery are part of the service. Marketing messages are sent only where a lawful basis exists, and you may unsubscribe at any time.

3. Notices may be sent to the email address, telephone number, Account, or other contact channel supplied with your order. You must keep those details current.

15 Changes to this Agreement

1. We may update this Agreement for legal, security, technical, or business reasons by publishing a revised version and changing the “Last updated” date.

2. Changes do not retroactively remove rights already earned or materially reduce a paid Product. If a material change affects an ongoing Product, we will provide reasonable notice where required by law.

16 Governing Law and Disputes

1. This Agreement is governed by the laws of Ukraine, without depriving a consumer of mandatory protections of the country in which the consumer habitually resides where those protections apply.

2. Before starting formal proceedings, send a written complaint to videohudozhnik.services@gmail.com. We will seek to resolve it in good faith.

3. If no resolution is reached, the dispute may be submitted to the competent courts under applicable procedural and consumer-protection rules. Any clause selecting a Ukrainian court applies only to the extent legally enforceable against the relevant consumer.

4. If any provision is invalid or unenforceable, it will be limited or removed only to the necessary extent; the remaining provisions continue in effect.

17 Language

This English version is provided for international customers. If it is used as a translation of the Ukrainian public offer and a conflict arises, the Ukrainian version prevails, except where mandatory law requires otherwise.
